These Terms and Conditions apply to the purchase of Products via our Website www.pinkandgreene.com and to the use of the site.
Pink and Greene is a trading name of Thames Street Media Ltd whose registered office is at St Stephens House, Arthur Road, Windsor, Berkshire SL4 1RU. Our company number is 07792638; our VAT number is 129041534.
Nothing in these Terms and Conditions affects your statutory rights.
- Buying Products
- If you buy any Products from our Website you agree to be bound by these Terms and Conditions.
- Prices on the Website are in pounds sterling and include VAT. If delivery charges apply we will tell you during the order process. Our delivery charges are set out in the Delivery section below.
- We try to make sure that prices are shown accurately but if we make a mistake we may notify you of the correct price before despatching your order to ask if you wish to proceed.
- Whilst we take care to ensure the accuracy and availability of our Website, no warranty is given in respect of either and no liability can be accepted.
- We are under no obligation to accept your order. Your order has been accepted when we despatch the Products to you. Title will pass on delivery of the order, provided that we have received payment in full.
- Prices and Payment
- We accept payment via credit card, debit card and PayPal.
- By providing information we request from you, you authorise us to obtain information about you from third parties (including credit reference and fraud detection agencies) to authenticate your identity and delivery address, validate your payment card and obtain authorisations for your payments.
- Delivery
- UK addresses
Delivery is free via Royal Mail 48 (second class) for orders of £15 or more to UK mainland addresses. Upgrade to Royal Mail 24 (first class) is £0.99.
For orders under £15, there will be a charge for packing and postage of £1.99 inc VAT, or £2.49 for orders sent by Royal Mail 24 (first class).
Orders received before 2pm (Monday to Friday) are dispatched same day when possible (but may not be during periods of exceptional demand).
Royal Mail 48 (second class) normally delivers within two working days (including Saturday). Royal Mail 24 (first class) normally delivers on the next working day (including Saturday). - Overseas addresses
Orders from, and deliveries to, non-UK addresses are currently suspended due to recent changes in customs regulations. - If anything is missing, incorrect or damaged, please let us know immediately via customersupport@pinkandgreene.com. We will meet the cost of return and at your option replace your Products or refund you for the price paid plus delivery.
- UK addresses
- Cancelling an order
- You may cancel your order before delivery or return it up to 14 days after delivery. After that, we may offer a credit note instead of a refund, or neither.
- To cancel an order before delivery, please send an email to customersupport@pinkandgreene.com. After delivery, please return the order to us as set out in the Returns section below.
- If you cancel an order on a ‘no-fault’ basis, then you are responsible for the cost of its return to us. Please return Products unused and in their original packaging. Please enclose the order number, or a copy of the invoice.
- Returns
- To return Products, please send them to Pink & Greene, Unit 30, Brookside Business Park, Cold Meece, Staffordshire, ST15 0RZ. Please enclose the order number or a copy of the invoice.
- We will process your refund as soon as we receive notice of your cancellation of the order.
- If the order is incorrect or damaged on delivery to you we will meet the cost of return and either replace it or refund you the price paid including the delivery charges.
- Refunds
- If an order is incorrect or damaged, we will refund the full value of the payment made to us, including delivery charges. If an order is returned for any other reason, we will refund the full value of the payment made to us but, on return of Products, may deduct any delivery charges.
- If you paid for Products by payment card, refunds will be made by re-crediting your payment card account. If you paid by PayPal, we will re-credit your PayPal account.
- All refunds will be made within 30 working days of either our email confirmation that your order has been cancelled or on receipt of the returned order.
- If a product is refunded, the associated donation to your good cause is also reversed.
- Liability for Products delivered
- We warrant to you that any Product purchased from us through our Website is of satisfactory quality and fit for the purposes for which products of the kind purchased from us are commonly supplied.
- Our total liability for losses you suffer as a result of us breaching these Terms of Sale is strictly limited to the purchase price of the Product you purchased and any losses which are a direct and foreseeable consequence of us breaching these Terms and Conditions.
- We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us. We are not responsible for any delay in, or failure of, performance of our obligations under these Terms and Conditions arising from any cause beyond our reasonable control. We do not exclude or limit in any way our liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any terms implied under the Sale of Goods Act 1979 or the Sale of Goods and Services Act 1982; any liability arising under the Consumer Protection Act 1987; or any matter for which it would be illegal for us to exclude our liability.
- Jurisdiction
- These Terms and Conditions are governed by the laws of England.
- Use of your personal information
- Please read our Privacy Policy which contains important information about the use of the personal information you provide when using this Website.
- Promotions
- The 'Tell a Friend' promotion is now discontinued. Codes already generated can still be redeemed under the same conditions as previously: orders must exceed £10 (excluding postage); customers may not nominate themselves or residents of the same address.
- Promotions which allow customers to obtain free cards may only be used once each per customer. Where multiple orders have been placed by customers resident at the same address, we reserve the right to decline to accept orders and to refund payments.
- Card Club discounts are applied automatically only after a customer account is upgraded to Card Club membership. There may be a delay between the first use of the Card Club code and this upgrade. Customers who wish to order again during this period, but whose accounts have not been upgraded, should use the CARDCLUB code again. Retrospective discounts will not be offered. The Card Club discount applies to all full-priced items but may not be applied to some items at discounted prices (particularly when the rate of the discount is higher than the Card Club discount: in these cases the promotional discount rate will be applied instead of the Card Club discount). The Card Club discount can change from time to time; the current rate is given on the Card Club information page.
